What is SISCOSERV?

“The integrated foreign trade system for intangible services and other operations that produce changes in equity.”

A professional travels abroad to provide a service that will be charged to the customer (Sales Module);
A company pays a commission to an agent abroad (Acquisition Module – even though it is an export agent);
Royalties remittance payment overseas ;
Outside training payment ;
A company in the IT area buys software from a foreign supplier via the Web (Acquisition Module);
Provision of services in Brazil to a foreign customer (Sales Module);
A company hires a foreign professional, who travels to Brazil to provide a service (Acquisition Module);
A Brazilian hospital performs surgery on a foreign patient (Sales Module).

There are three possible penalty situations. They are:

Presentation of records outside the established deadlines: a fine ranging from R$100.00 to R$1,500.00 per month of delay ;
failure to comply with a request from the Federal Revenue Service, either to comply with an ancillary obligation or to provide clarifications to the tax authority: a fine of R$500.00 per month;
omitting information or using inaccurate or incomplete data: a fine varying between 1.5% and 3.0% of the value of the commercial transactions or financial transactions carried out.

Suppliers or borrowers of the service residing or domiciled in Brazil;
Natural persons or legal entities, residing or domiciled in Brazil, who makes transfers or acquisitions of intangible assets through assignment, concession, licensing, or by any other legal means. This group includes intellectual property rights;
Natural persons or legal entities, or the person responsible for the depersonalized entity, residing or domiciled in Brazil, who carries out other operations that produce changes in equity.
